For most personal injury cases, there is no up-front cost to you. We work on a contingency fee basis, which means that we only get paid if you receive compensation for your injuries.  


After practicing law for 30 plus years, I can tell you that there is a difference between what happens in real life and what happens in a courtroom.  My job as an attorney is to try to make those match as much as possible.  Unfortunately, over time, memories fade, dangerous conditions get fixed (which is good for the pubic, but not necessarily for your case), data gets erased, videos get recorded over, etc.  That is why you need to hire me as soon as possible, so that we can make sure key evidence is preserved.   For example, you can talk until you're blue in the face about how icy a sidewalk was and how hard you slammed into the concrete when you fell.  But nothing will tell that  story as effectively as video from a camera at the front of the store.  However, in my experience, most surveillance systems record over the existing data roughly every 30 days unless the property owner receives a preservation letter asking them to pull the footage before then.  Also, there are deadlines for filing a lawsuit, and if that deadline is missed, your case has no value after that.


Police misconduct and brutality can have devastating consequences.  The same is true when jailers fail to provide for inmates' serious medical needs or protect them from violence.  In fairness, policing can be a hard job, and well trained and ethical officers deserve our gratitude.  However, when police are given a lot of power and not a lot of training, they have time and again been captured on video displaying cruelty, racism, and excessive force.  In particular,  our society does not always do the best job of helping people with mental health and addiction problems.  Sometimes the police called for assistance are the very ones who instead end up killing or brutalizing the people they were supposed to be helping. Sadly, it is not uncommon for people fighting addiction and mental health problems to wind up in jail or prison.  Once they are incarcerated, the state takes away their ability to care for themselves.  Even healthy prisoners can be subject to violence and danger.  At that point, the government or jail has constitutional obligations to care for inmates' serious medical needs and safety.  As a society, we need to do better at holding those in power accountable when they fail to fulfill those duties.  Lawsuits against police and other government agencies can be complicated and challenging.   The police and jailors are given a LOT of defenses.   That is why it is important that you hire an experienced attorney.  I began my career more than 30 years ago at the Missouri Attorney General's Office, and I have continued working in civil cases brought against government actors ever since.  In fact, I have been flown around the country to provide education to law enforcement officers about their constitutional obligations.  Let me use this knowledge to help you.


To the extent you can, take photos at the scene, showing the damage to all vehicles involved, the placement of the vehicles , any debris on the road, and any skid marks.  Get the names and contact information for any and all witnesses as soon as you can.  DO NOT RELY ON THE POLICE TO DO THIS FOR YOU!  They are doing their best to get the traffic cleared to avoid more accidents.  Once those other vehicles have been removed from the scene, we may likely have no way to ever find them again.  Hire a lawyer as soon as possible.  Many vehicles on the road today have digital information recorded, and that data needs to be downloaded as soon as possible before it is overwritten.  


Obviously, you should get appropriate medical treatment as quickly as possible.  Less obviously, you also need to document the injuries.  If possible, get your phone out and take photos as soon as you can. Then, follow up with update photos of the wounds as they heal.  Nothing communicates your pain, struggles, and treatment journey more effectively.  If the dog is roaming freely, try to get a video/photo of that as well.


Take photos of where you fell as quickly as you can.  After that, if possible, let the property owner know of the problem, so they can fix it and prevent any one else from getting hurt.  Contact us as soon as possible, so we can take the legal steps necessary to ensure the property owner preserves any video and other evidence of the your accident.
